Terms and Conditions between Employers, Recruitment Agents and Global Job Search Ltd.

 

1. Definitions

 
1.1
In this agreement, the words “we'”, “us” and “our” mean “Global Job Search Ltd” of 80 Paxman Avenue, Colchester, Essex, CO2 9DA, United Kingdom. The words “you” and “your” mean the person or company entering into this agreement with us.
 

2. Our Service

 
2.1
On receipt by us of your submitted information, you will be deemed to have accepted all of these terms and conditions, and will be granted access, subject to a credit check, to our database in accordance with these terms and conditions. You also agree that all of the information you supply to us is correct, truthful, and complete. You agree to inform us by email, telephone, or post of any changes to any of the information supplied by you to us. We reserve the right to terminate this agreement in the event that any of the information provided by you to us, is no longer current or accurate.
 
2.2
We will take reasonable steps to provide a reliable service to you. However, we cannot guarantee the accuracy or authenticity of any of the CVs stored in our databases. You acknowledge and accept that this is beyond our control, and refunds cannot be given in the event of untruthful information being submitted by candidates.
 

3. Your Obligations and Undertakings

 
3.1
You will not disclose your username and/or password to any persons outside of your company. If disclosure occurs we reserve the right to terminate this agreement immediately and seek compensation.
 
3.2
You acknowledge and accept that all rights to information provided by third parties are reserved by those third parties, and that such information may not be used in any way that infringes any proprietary interests of those third parties. You agree not to disclose any information provided by the candidates to any third parties, or those not directly related to the recruitment process of the individual(s) in question.
 
3.3
Any personal details which you provide to us from which we can identify you are held in accordance with our Data Protection Registration. You agree that you do not object to us using this information to contact you for the purpose of improving our service to you, requesting payment(s), discussing account status, and you confirm that you do not consider any of the above as a breach of any of your rights under the Telecommunications (Data Protection and Privacy) Regulations 1999.
 
3.4
You agree that your details will be available to Global Job Search Ltd staff, but we will not disclose theses details to anybody outside of our organisation.
 
3.5
Downloading or taking content from our CV database using any software other than a browser, wholly or in part, for any reason other than recruiting for a current vacancy is strictly forbidden and will result in immediate cancellation of your account, without refund and may result in legal action taken against you.
 
3.6
Contacting candidates via email or other means, for any reason other than recruitment, is strictly forbidden.
 

4. Passwords

 
4.1
You agree to notify us as soon as is reasonable, knowledge that your password is, or may be, known to any person(s) other than those within your organisation. Upon notification of such an event, we will render such password inoperable, and will issue a new password by a mutually agreed method (telephone or email or post).
 

5. Charges

 
5.1
You agree to pay the entire balance of your account each month, prior to the commencement of the service for that month. You agree that payments will be made by credit/debit card or bank transfer. You acknowledge and agree that in the event of failure by you, or the person with whom responsibility lies for payment of such transactions, that we may terminate your account and cancel this agreement immediately. We may also pursue payment in a court of law.
 
5.2
You agree to the payment structure agreed with your account manager, and agree to be charged in accordance with it.
 
5.3
You agree that we may alter rates at anytime without notification. If you do not wish to continue this agreement with the altered rates, you may terminate the agreement in accordance with section 7 of this agreement.
 

6. Refunds

 
6.1
Refunds cannot be provided if the candidate is not of the desired age, sex, race, or nationality, as these criteria contradict our equal opportunities policy, and common decency.
 
6.2
A 'cooling off' period of 48hrs is allowed. Should you wish to terminate your account during this period a full refund minus an administration charge will be given.
 

7. Termination

 
7.1
The terms and conditions of this agreement will continue unless terminated by you or us, by notice in accordance with this section.
 
7.2
Under normal circumstances we may terminate this agreement, after 30 days notice of our intention to terminate, by post, using the postal address you provided us upon registering (or any new address that you may have provided us). You may terminate this agreement at anytime by contacting us, by post, and requesting that your account be cancelled. Your account will be terminated at the end of the calendar month in which we receive your notification. Any outstanding balance will be invoiced at the end of that calendar month.
 
7.3
We reserve the right to terminate this agreement immediately, with no further obligation to you, upon the occurrence of any of the following events:

1) You fail to pay any amount due to us in accordance with section 5.
2) You are a limited company and call a meeting of creditors or are otherwise the subject of proceedings under the Insolvency Act of 1986, or are unable to pay your debts as they fall due within the meaning of section 123 of the Insolvency Act of 1986.
3) You are an individual and are declared bankrupt or enter into any arrangement or compromise with your creditors
4) You breach any of the terms and conditions of this agreement.
 

8. Our Liabilities and Limitations

 
8.1
Other than through our negligence or wilful default, we shall not be liable for any losses, damages or claims which result directly or indirectly from any person obtaining any passwords that we have issued you.
 

9. General

 
9.1
These terms and conditions are the whole agreement between you and us.
 
9.2
You agree that we may vary these terms and conditions without any notification.
 
9.3
The terms and conditions of this agreement are governed by English Law, and the parties agree to submit to the exclusive jurisdiction of the English Courts.

Definitions

"4 European Jobs.com": means Global Job Search Ltd, 80 Paxman Avenue, Colchester, Essex, CO2 9DA, United Kingdom.
"The Candidate": The person using this site for career related purposes.
"The Employer": The person using this site for recruitment purposes.
 

1. General disclaimer of liability for content

4 European Jobs.com is providing this site on an 'as is' basis and makes no representations or warranties of any kind with respect to this site or its contents and disclaims all such representations and warranties. In addition, 4 European Jobs.com is part of a network of global job boards and makes no representations or warranties about the accuracy, completeness, or suitability for any purpose of the information and related graphics published in this site. Due to accepting content from a global network of job boards, the information contained in this site may contain technical inaccuracies or typographical errors. All liability of 4 European Jobs.com howsoever arising for any such inaccuracies or errors is expressly excluded to the fullest extent permitted by law.

Neither 4 European Jobs.com nor any of its directors, employees or other representatives will be liable for loss or damage arising out of or in connection with the use of this site. This is a comprehensive limitation of liability that applies to all damages of any kind, including but not limiting it to compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties.

None of the exclusions and limitations in the clause are intended to limit any rights you may have as a consumer governed by English law or other statutory rights which may not be excluded nor in any way to exclude or limit 4 European Jobs.com liability to you for death or personal injury resulting from our negligence or that of our employees or agents.
 

2. Global Job Search’s Promises

4 European Jobs.com will permit the Candidate and Employer to access, use and interact with our site subject to these terms and conditions.

2.2
4 European Jobs.com shall:

Exercise reasonable care in compiling our site.

2.2.2
Take the steps to limit the distribution of personal data the Candidate provides to the network of job boards 4 European Jobs.com is part of.
 

3. Variations

 
3.1
4 European Jobs.com reserves the right at any time without notice to revise the content of the site (including but not limiting it to pricing and the service offered by 4 European Jobs.com) and these terms and conditions. Any changes to these terms and conditions will be posted on the site and by continuing to use the site following any such change the Candidate will signify that you agree to be bound by the revised terms and conditions of use.
 

4. The use of information

 
4.1
Information will be collected and recorded in accordance with the privacy policy. The Candidate acknowledges and agrees for both 4 European Jobs.com and the network of job boards, it is a member of to collect and record any submitted information.

4.2
The Candidate is liable be contacted by the Employer without intervention from 4 European Jobs.com.

4.3
Employers may only use information supplied by us for the purposes of recruiting and shall not disclose any information to any third parties other than those directly related to the recruitment process of the candidate.

4.4
Any party using this service for any purpose other than those specifically stated in these Terms and Conditions shall immediately be banned from using this site.
 

5. Enhanced Candidate Profile

 
5.1
We do not guarantee that by subscribing to an enhanced profile you will secure a job. This is simply a tool that will enhance your visibility to recruiters and employers.

5.2
We do not store your credit/debit card details.

5.3
Purchase of the enhanced candidate profile is optional, and you may search and apply to jobs on 4 European Jobs.com upon completion of your online CV.
 

6. Discrimination Policy

 
6.1
4 European Jobs.com does not discriminate against anyone registered to or using the 4 European Jobs.com website. We try to ensure that all possible measures are taken to prevent any vacancies advertised or searches do not discriminate against age, disabilities, gender or race. The search tools in place on the site does not have the functionality to exclude any candidates with disabilities. It is down to the users themselves to ensure they comply with discrimination laws.
